Save as otherwise provided in this Agreement, to the maximum extent permissible by law all warranties, conditions or terms other than those expressly set out in this Agreement are excluded, including, but not limited to implied and statutory conditions and warranties.
We shall not be liable for loss of business revenues, lost profits or any punitive, indirect, consequential, special or similar damages whatsoever, whether in contract, tort or otherwise, even if advised of the possibility of such damages incurred by you or any third party.
We give no warranty as to the performance of the internet generally or the Pages. The Pages may be subject to arbitrary delays beyond our control.
The sources of the Information shall have the right to enforce the provisions of this Agreement pursuant to the Contracts (Rights of Third Parties) Act 1999, although the terms of this Agreement can be varied without the consent of sources of Information other than Hemscott.
The Agreement shall be construed in accordance with and governed by English Law and shall be subject to the exclusive jurisdiction of the English Courts.

Terms and Conditions of Use of Morningstar Real-Time Data Limited Information

All information provided by Morningstar Real-Time Data Limited ("Morningstar") and its affiliates (the "Morningstar Information") on the Hemscott website is owned by or licensed to Morningstar and its affiliates and any user is permitted to store, manipulate, analyze, reformat, print and display the Morningstar Information only for such user's personal use. In no event shall any user publish, retransmit, redistribute or otherwise reproduce any Morningstar Information in any format to anyone, and no user shall use any Morningstar Information in or in connection with any business or commercial enterprise, including, without limitation, any securities, investment, accounting, banking, legal or media business or enterprise.

Prior to the execution of a security trade based upon the Morningstar Information, you are advised to consult with your broker or other financial representative to verify pricing information.

Neither Morningstar nor its affiliates make any express or implied warranties (including, without limitation, any warranty or merchantability or fitness for a particular purpose or use) regarding the Morningstar Information.
